Activision took a long time to hand over the source to Call to Power II, saying that they would only do so if it wasn't used for commercial gains.

I know that EA are probably harder to bargain with, but I'm sure that if you found the right person at EA then you could talk them round a bit. At the end of the day, they've abandoned the game (after tearing apart Bullfrog, one of the best game studios ever).

It'd be useful to get them on board with regards to an OpenSource project. Maybe someone "in charge" here at Corsix could appoint someone to enter more considered negotiations with EA. If they can get something out of it with doing no work whatsoever then I'm sure they'd be please do co-operate. You just need to work out what that something is!

Getting EA to release the source code for Theme Hospital would be a fantastic step in the progress of CorsixTH, While searching Google I found this website http://gpl.ea.com/ which claims to be source code released officially, i didn't take a long look at it though.
Appointing somebody to deal with EA about the source code is a good idea, a post could be made in the Official announcements every couple of days telling people how the progress with EA is going.

I'm particularly thinking that it might be an idea to set up a particular facebook group or similar for people to add their support to an updated, OpenSource version of TH. I know loads of the people who remember the game from 10+ years ago and would love the nostalgia trip.

The problem is that if there isn't a single appointed point of contact with EA then mixed messages will be sent, wires will get crossed at EA and it'll generally look unprofessional and awkward. Also, with regards to facebook groups, if no one is managing them and if there aren't properly centralised groups and petitions to EA then you end up with lots of different, fragmented ones and the potential to use them to further your case will be ruined.

It'd be well worth getting in touch with EA properly. They might release the source and, better still, might ultimately agree to offer legitimate use of their graphics for the project (if they saw some kind of potential for them, e.g. people seeing that they're supporting OS versions of abandonware and trying other EA games). CorsixTH just needs to sell itself well as something that can benefit EA, rather than something that is trying to steal their intellectual rights.

OK, lego3. Point taken, although I don't know where you'd currently stand legally should you start using EA's graphics and sounds (whether you distributed them or not) in a game "that resembles" theme hospital...

I don't have much faith in ProjectTH - I feel they might jeopardise any potential future collaborations with EA.

Project-th was not a collaboration with ea , i asked for copyright permission to use graphics and sounds.They decclined without a reason.If Corsix was to go open source with the graphics and sounds without the original game files load it would be under copyright infringement.
If i have support in project-th ill continue my work , but under pressure from ea im afraid that project-th may shut down because it is un-able to continue development.

There's no reason why we can't make our own maps. We can even script new campaign levels. I don't see why we can't create new staff either.

No, I really don't think it would be. The last thing the project needs is to split the community between those who want to update the old code base and those who want to reverse engineer the game. The first route may be faster, but it's more than likely that the code would come with some really stupid conditions (eg. some condition that after 3 years EA gains full control over the code, etc.) Plus, reverse engineering the game is likely to ultimately result in a better code base, among other things.

But seriously though, will jackyboyhenry please release the tool you used to extract the game graphics? I've been trying to get soemthing like that work but to no avail :(

Well, the only ways it can be released as freeware is:
1. Bullfrog gives the authority to use some files.
2. EVERYTHING needs to be changed out with self-produced files (which i get the idea of is the case here).

But it takes time to make a complete remake of a game.
